ENID, Okla. A 26 year old Enid man was charged Thursday with a count of first degree rape accusing him of having sex with an unconscious woman in May.

A warrant was issued for the arrest of Jemial Dashawn Lofton last week, and bond on the warrant was set at $500,000. Police arrested Lofton Sunday morning in the 1300 block of East Cherokee after Lofton called police to report a theft.

Because of four prior felony convictions, Lofton faces 20 years, life in prison or life in prison without the possibility of parole on the rape charge.

On May 25, a woman reported to Enid police that she was sexually assaulted at the Ramada Inn, 3005 W. Garriott, according to an affidavit filed in the case. May 23.

The woman said she’d gone to the Ramada with some female friends to have a girls day, which included swimming at the pool. She said at some point in the night three men showed up at their room, according to the affidavit. The woman said they began drinking, and she remembers drinking about two beers and a shot or two of liquor. She said Lofton would keep putting his arm around her, and she would push him off and asked him to stop.

The woman said Lofton would get close to her face when they would talk and several times tried to kiss her, according to the affidavit. The woman said she would turn away and ask Lofton not to do that.

The woman told police she does not remember much else about the night and apparently passed out on the bed in the room, according to the affidavit. The woman said when she woke up she was on her left side and Lofton was behind her, having sex with her. The woman said she pushed him away,

got up and began searching for her clothes so she could get out of the room.

The woman told police she was scared at that time and did not know if Lofton would hurt her but did question Lofton as to why he would do that to her when she was asleep, according to the affidavit. The woman said Lofton told her several times he wore a condom and even showed her the condom, telling her she would be OK because he wore it.

The woman said Lofton told her several times, “Don’t get me in trouble with the law,” according to the affidavit. The woman said she was able to contact a friend, who took her home where she took a shower because she felt “gross.”

The woman said she was scared to make a report with police but was encouraged by several people to do so, according to the affidavit. A sexual assault nurse examination was performed, and Detective James Buck sent samples from the exam to Oklahoma State Bureau of Investigation for testing.

On Sept. 12, Buck received DNA lab results that showed two male contributors had left DNA on the woman, according to the affidavit. Buck noted in the affidavit the woman told him she had consensual sex with a man several days prior to the incident.

The results indicate one of the two contributors was consistent with a sample from three known Loftons from a DNA database, according to the affidavit. The results show the three known samples from those Loftons, or their male relatives, as being the potential source of the profile obtained.
